These guidelines are for Âé¶¹ÊÓÆµ licensees, authorized resellers, developers, customers, and other parties wishing to use Âé¶¹ÊÓÆµ's trademarks, service marks, or images in promotional, advertising, instructional, or reference materials, or on their web sites, products, labels, or packaging. Use of Âé¶¹ÊÓÆµ trademarks may be prohibited, unless expressly authorized.

If you are a licensee of a Âé¶¹ÊÓÆµ trademark or logo and have been provided with special trademark usage guidelines with your license agreement, please follow those guidelines. If your license agreement does not provide usage guidelines, then follow these guidelines.

Âé¶¹ÊÓÆµ's trademarks, service marks, trade names, and trade dress are important assets. In following these guidelines, you help us protect our valuable trademark rights and strengthen our corporate and brand identities. By using a Âé¶¹ÊÓÆµ trademark, in whole or in part, you are acknowledging that Âé¶¹ÊÓÆµ is the sole owner of the trademark and promising that you will not interfere with Âé¶¹ÊÓÆµ's rights in the trademark, including challenging Âé¶¹ÊÓÆµ's use, registration of, or application to register such trademark, alone or in combination with other words, anywhere in the world, and that you will not harm, misuse, or bring into disrepute any Âé¶¹ÊÓÆµ trademark. The goodwill derived from using any part of a Âé¶¹ÊÓÆµ trademark exclusively inures to the benefit of and belongs to Âé¶¹ÊÓÆµ. Except for the limited right to use as expressly permitted under these Guidelines, no other rights of any kind are granted hereunder, by implication or otherwise. Rules for Proper Use of Âé¶¹ÊÓÆµ Trademarks

Trademarks are adjectives used to modify nouns; the noun is the generic name of a product or service. As adjectives, trademarks may not be used in the plural or possessive form. Do not use a trademark as a verb. An appropriate generic term must appear after the trademark the first time it appears in a printed piece and as often as is reasonable after that.

Always spell and capitalize Âé¶¹ÊÓÆµ's trademarks exactly as they are shown in Âé¶¹ÊÓÆµâ€™s Products web page. Do not shorten or abbreviate Âé¶¹ÊÓÆµ product names. Do not make up names that contain Âé¶¹ÊÓÆµ trademarks.

When making fair use of a Âé¶¹ÊÓÆµ trademark, you must mark and attribute them as outlined in these guidelines.

Âé¶¹ÊÓÆµ trade dress may not be used by third parties for their own products or web sites. Please ensure that your product line, packaging, advertising or web site does not adopt a look that is confusingly similar to any of Âé¶¹ÊÓÆµâ€™s.

Authorized Use of Âé¶¹ÊÓÆµ Trademarks

Advertising, Promotional, and Sales Materials

Only Âé¶¹ÊÓÆµ and its authorized resellers and licensees may use the Âé¶¹ÊÓÆµ Logo in advertising, promotional, and sales materials. Âé¶¹ÊÓÆµ Authorized Resellers may use the Âé¶¹ÊÓÆµ Logo only as specified in their reseller agreement.

Compatibility

Developers may use Âé¶¹ÊÓÆµ or any other Âé¶¹ÊÓÆµ word mark (but not the Âé¶¹ÊÓÆµ Logo or other Âé¶¹ÊÓÆµ-owned graphic symbol/logo) in a referential phrase on packaging or promotional/advertising materials to describe that the third party product is compatible with the referenced Âé¶¹ÊÓÆµ product or technology, provided they comply with the following requirements:

  • The Âé¶¹ÊÓÆµ word mark is not part of the product name.
  • The Âé¶¹ÊÓÆµ word mark is used in a referential phrase such as "for use with," "for," or "compatible with."
  • The Âé¶¹ÊÓÆµ word mark appears less prominent than the product name.
  • The product is in fact compatible with, or otherwise works with, the referenced Âé¶¹ÊÓÆµ product.
  • The reference to Âé¶¹ÊÓÆµ does not create a sense of endorsement, sponsorship, or false association with Âé¶¹ÊÓÆµ or Âé¶¹ÊÓÆµ products or services.
  • The use does not show Âé¶¹ÊÓÆµ or its products in a false or derogatory light.

Publications, Seminars, and Conferences

You may use a Âé¶¹ÊÓÆµ word mark in connection with book titles, magazines, periodicals, seminars, or conferences provided you comply with the following requirements:

  • The use reflects favorably on both Âé¶¹ÊÓÆµ and Âé¶¹ÊÓÆµ products or technology.
  • Your name and logo appear more prominent than the Âé¶¹ÊÓÆµ word mark on all printed materials related to the publication, seminar or conference.
  • The Âé¶¹ÊÓÆµ logo or any other Âé¶¹ÊÓÆµ-owned graphic symbol, logo, icon or image does not appear on or in the publication or on any materials related to the publication, seminar, or conference without express written permission from Âé¶¹ÊÓÆµ.
  • A disclaimer of sponsorship, affiliation, or endorsement by Âé¶¹ÊÓÆµ, similar to the following, is included on the publication and on all related printed materials: "(Title) is an independent (publication) and has not been authorized, sponsored, or otherwise approved by Âé¶¹ÊÓÆµ."
  • A trademark attribution notice is included in the credit section giving notice of Âé¶¹ÊÓÆµâ€™s ownership of its trademark(s). Please refer to the section below titled "Proper Trademark Notice and Attribution."

Links

You may place a link to a Âé¶¹ÊÓÆµ web page on your site if the text link is not a prominent feature on the site or used in a way to mislead or confuse consumers. You may refer to the Âé¶¹ÊÓÆµ name or product or service names in a plain text font and format provided the use follows Âé¶¹ÊÓÆµ's trademark guidelines and you include appropriate wording such as "link to weyerhaeuser.com".

Unauthorized Use of Âé¶¹ÊÓÆµ Trademarks

Company, Product, or Service Name

You may not use or register, in whole or in part, Âé¶¹ÊÓÆµ or any other Âé¶¹ÊÓÆµ trademark, including Âé¶¹ÊÓÆµ-owned graphic symbols, logos, icons, or an alteration thereof, as or as part of a company name, trade name, product name, or service name except as specifically noted in these guidelines or pursuant to an express written license from Âé¶¹ÊÓÆµ.

Âé¶¹ÊÓÆµ Logo and Âé¶¹ÊÓÆµ-owned Graphic Symbols

You may not use the Âé¶¹ÊÓÆµ Logo or any other Âé¶¹ÊÓÆµ-owned graphic symbol, logo, or icon on or in connection with web sites, products, packaging, manuals, promotional/advertising materials, or for any other purpose except pursuant to an express written trademark license from Âé¶¹ÊÓÆµ, such as a reseller agreement. You may request permission to use the Âé¶¹ÊÓÆµ Logo or any other Âé¶¹ÊÓÆµ-owned logo by contacting us.

Variations, Takeoffs or Abbreviations

You may not use an image of a real Âé¶¹ÊÓÆµ logo or other variation of the Âé¶¹ÊÓÆµ logo for any purpose. Third parties cannot use a variation, phonetic equivalent, foreign language equivalent, takeoff, or abbreviation of a Âé¶¹ÊÓÆµ trademark for any purpose.

Slogans and Taglines

You may not use or imitate a Âé¶¹ÊÓÆµ slogan or tagline.

Âé¶¹ÊÓÆµ's Trade Dress and Advertising Elements

Âé¶¹ÊÓÆµ trade dress may not be used by third parties for their own products or websites. Please ensure that your product line, packaging, advertising or web site does not adopt a look that is confusingly similar to any of Âé¶¹ÊÓÆµâ€™s. All page headers, custom graphics, button icons, and scripts are trademarks and/or trade dress of Âé¶¹ÊÓÆµ and may not be copied, imitated, or used in whole or in part, without the prior written permission of Âé¶¹ÊÓÆµ.

Endorsement or Sponsorship

Âé¶¹ÊÓÆµ does not support the use of its logos, company names, product names, or images of Âé¶¹ÊÓÆµ products by other parties in marketing, promotional or advertising materials as their use may create the perception that Âé¶¹ÊÓÆµ endorses or sponsors the product, service or promotion.

Domain Names

You may not use any Âé¶¹ÊÓÆµ trademark or virtually identical trademark in the title of your web site, as a second-level domain name, or subdomain.

Not acceptable:

  • "trusjoist.com"
  • "trusjoistÂé¶¹ÊÓÆµ.com"
  • "Yourname.Âé¶¹ÊÓÆµ.com"

Merchandise Items

You may not manufacture, sell or give-away merchandise items, such as T-shirts and mugs, bearing Âé¶¹ÊÓÆµ or any other Âé¶¹ÊÓÆµ trademark, including symbols, logos, or icons, except pursuant to an express written trademark license from Âé¶¹ÊÓÆµ.

Disparaging Manner

You may not use a Âé¶¹ÊÓÆµ trademark or any other Âé¶¹ÊÓÆµ-owned graphic symbol, logo, or icon in a disparaging manner.

Proper Âé¶¹ÊÓÆµ Trademark Notice and Attribution

All Âé¶¹ÊÓÆµ trademarks must be property attributed. Trademark ownership is attributed in two ways:

  • With the use of a trademark symbol (TM, SM, ®) after the trademark.
  • With a trademark legend, usually placed at the end of a document in fine print directly after the copyright notice

Trademark Symbols

The appropriate trademark symbol must be used when making reference to any Âé¶¹ÊÓÆµ trademarks. The appropriate symbol for each of Âé¶¹ÊÓÆµâ€™s trademarks is indicated in the products section of this website. If a product or trademark is not listed, please contact trademarks@weyerhaeuser.com.

Wherever possible, the symbol should be placed directly after the trademark in a superscript and in a size smaller than the mark itself. If you are unable to use the symbols due to the software you are using, you should use parenthetical versions as follows: (R), (tm), or (sm).

The trademark symbol does not need to be included in every use of the trademark. The trademark symbol must always be used:

  • Upon the first use of the Âé¶¹ÊÓÆµ trademark appears the text of the advertisement, brochure, or other material; and
  • For all prominent uses of the trademark including title pages or headings.

Trademark Legends

Âé¶¹ÊÓÆµ trademarks and products must be properly identified as originating from Âé¶¹ÊÓÆµ by including a brief statement (legend) attributing ownership of these trademarks to Âé¶¹ÊÓÆµ within the credit notice section of your product, product documentation, or other product communication. The following legend should be used on all materials that reference Âé¶¹ÊÓÆµ trademarks:

  • Âé¶¹ÊÓÆµ, [list Âé¶¹ÊÓÆµ trademarks/products referenced in the materials], are trademarks or registered trademarks of Âé¶¹ÊÓÆµ NR Company or its subsidiaries in the U.S. and other countries.

The trademark legend must be clear in order to avoid any confusion over who is the owner of each mark. Following are the correct formats:

  • Âé¶¹ÊÓÆµ and Trus Joist are registered trademarks of Âé¶¹ÊÓÆµ NR Company.

Âé¶¹ÊÓÆµ trademarks should be specifically credited and not referred to generically as "...all other trademarks are owned by their respective companies" or similar language.

Do not use or add any other statements to the legend that in any way suggest that you have or are claiming any rights in a Âé¶¹ÊÓÆµ trademark.

No Challenges

You agree that you will not challenge, encourage, assist, or otherwise induce third parties to challenge the Âé¶¹ÊÓÆµ marks (except to the extent such restriction is prohibited by law) or our registration thereof, nor shall you attempt to register any trademarks, service marks, trade names, logos, product names, service names, legends, domain names, other designations, or abbreviations of any of the foregoing, or other distinctive brand features that are confusingly similar in any way (including, but not limited to, appearance and spelling)to the Âé¶¹ÊÓÆµ marks.

Warranty

USE OF ANY WEYERHAEUSER TRADEMARK IS AT YOUR OWN RISK. THE USES PERMITTED HEREUNDER ARE PROVIDED BY WEYERHAEUSER "AS IS", WITHOUT ANY WARRANTIES WHATSOEVER, INCLUDING (WITHOUT LIMITATION) ANY WARRANTY OF NON-INFRINGEMENT. YOU AGREE TO INDEMNIFY AND DEFEND WEYERHAEUSER AND HOLD WEYERHAEUSER, ITS SUCCESSORS AND ASSIGNS, HARMLESS OF AND FROM ANY CLAIM, ACTION, SUIT, LOSS, COST, EXPENSE OR OTHER DAMAGES OR LIABILITY WHATSOEVER (INCLUDING, WITHOUT LIMITATION, REASONABLE ATTORNEYS' FEES) ARISING OUT OF OR RESULTING FROM YOUR USE OF ANY WEYERHAEUSER TRADEMARKS IN VIOLATION OF THE WEYERHAEUSER TRADEMARK AND LOGO USAGE REQUIREMENTS.

Use of Âé¶¹ÊÓÆµâ€™s Copyrighted Content and Materials

Âé¶¹ÊÓÆµ products, services, marketing materials, and Web content, including images and text, are owned by Âé¶¹ÊÓÆµ and/or by Âé¶¹ÊÓÆµ vendors, who have given Âé¶¹ÊÓÆµ permission to use the material. Only Âé¶¹ÊÓÆµ and its authorized resellers and licensees may use Âé¶¹ÊÓÆµâ€™s images and text in advertising, promotional, and sales materials.
